Policy on Sale of Second- Hand Books

1. Purpose and Applicability

This policy governs the use, circulation, and sale of educational books and printed learning material (“Books”) published, owned, or distributed by Tata ClassEdge Limited (“Tata ClassEdge”) hereinafter referred to as “Policy”. It is binding upon all purchasers, users, dealers, educational institutions, retailers, and third parties who come into possession of such Books.

2. Restrictions and Prohibition on Secondary Sale

All Tata ClassEdge Books are protected under the provisions of The Copyright Act, 2012 and other applicable laws. The resale, trade, donation, distribution, or exchange of any used or second-hand Tata ClassEdge Books for commercial or non-commercial consideration is strictly prohibited. This includes listing books on: (i) Online marketplaces; (ii) E-commerce platforms; (iii) Book resale apps; (iv) Physical resale via bookstores, book fairs, or other channels.

This includes:

  • Listing or selling second-hand Tata ClassEdge Books on online or offline platforms or E-commerce platforms or book resale apps.
  • Supplying or resale of used books to bookstores, book fairs, institutions, individuals or other channels.
  • Participating in or facilitating any transaction that results in the reuse of Tata ClassEdge Books not directly sourced from the Company or its authorized distributors.
  • Reproducing, scanning, or sharing digital copies or excerpts of the Books for resale or redistribution in any manner.

3. Intellectual Property and License Conditions

All content, including text, design, images, and layout in Tata ClassEdge Books, constitutes proprietary intellectual property and the copyrights in such content, including text, design, images, and layout in Tata ClassEdge Books exclusively belongs to Tata ClassEdge. Purchase of such Books grants the buyer a limited, non-transferable, non-sublicensable, and non-exclusive license to use the Books strictly for personal, educational use. This license does not include any ownership rights to transfer, sell, resell, or circulate the Books in any form or in any manner.

4. Penalty and Prosecution Clause

Any contravention of this Policy shall be treated as infringement of copyright under The Copyright Act, 2012, and may also attract liability under Section 316 (Criminal Breach of Trust), 318 (Cheating), and other relevant sections of the Bharatiya Nyaya Sanhita 2023.

Tata ClassEdge reserves the right to:

  • Issue cease-and-desist notices to violators.
  • Initiate civil proceedings for permanent injunction and damages.
  • File criminal complaints against individuals and entities found in violation.
  • Seek punitive damages for willful and commercial infringement.
  • Legal proceedings to recover damages or enforce intellectual property rights.

5. Reporting Violations

To report unauthorized sale, resale, or circulation of Tata ClassEdge Books, contact the Legal Department at: legal@tataclassedge.com

All reports will be treated with confidentiality and acted upon with urgency.

6. ISBN Ownership and Use Restriction

Each Tata ClassEdge Book is assigned a unique International Standard Book Number (ISBN), which is registered under the ownership of Tata ClassEdge Limited. The ISBN:

  • Is for identification and cataloguing purposes only, and
  • Does not entitle the purchaser to reproduce, resell, or distribute the book, whether in its original or derivative form.

 

Any use of the ISBN for listing on third-party platforms, catalogues, or point-of-sale systems for resale or redistribution of the book, whether digital or physical, shall be deemed unauthorized and illegal. Tata ClassEdge reserves the right to initiate legal proceedings against any such misuse under the provisions of the Copyright Act, 2012, and applicable penal laws.

7. Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India. Any and all disputes arising out of or in connection with this Policy, including any questions regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts at Mumbai alone.

8. Reservation of Rights

Tata ClassEdge retains the right to periodically review and modify or update this Policy at any time without prior notice to reflect any changes in legal requirement. Enforcement actions shall be undertaken at the sole discretion of Tata ClassEdge and in accordance with applicable law.
